This Acceptable Use Policy specifies the restrictions applied to the service you are subscribing to from HostRainbow IN. This policy is created and followed carefully to ensure the protection, integrity, reliability, and privacy of HostRainbow IN as a web hosting provider. HostRainbow IN reserves the right to change this policy at any time, and modifications take effect immediately. You alone are responsible for all actions that occur during your use of HostRainbow’s services, and you agree not to use the services for prohibited activities.

Please note that this Acceptable Use Policy is subject to change, and it is the customer’s responsibility to regularly check for modifications. (Customers, users, and visitors are referred to collectively as Customers).

Prohibited Content:

The following content is not accepted on our servers and network:

  • Any activity that can lead to the IP being blocked by organizations such as Spamhaus
  • Underage nudity
  • Scam/fraudulent websites
  • Spam
  • Illegal pharmaceutical websites
  • Websites associated with hacks or cheats
  • Mass mailing
  • Reverse proxies
  • Selling illegal substances
  • Phishing websites
  • Botnet controllers
  • DDoS scripts
  • Brute force attacks
  • Packet flood scripts
  • SIP scanners
  • IP spoofing attacks
  • Virus/Trojan/malware distribution
  • Password scanning and password-guessing tools, bots, and/or software
  • Vulnerability scanners
  • Terrorist websites
  • Anything related to forex
  • Unlicensed IPTV services
  • Anything related to in-game virtual currencies and generators thereof
  • The sale or distribution of replica items
  • Child pornography
  • Game hosting servers
  • Distributed Denial of Service (DDoS)
  • Port scanning
  • Virus, Trojan, and malware distribution
  • Offensive material
  • Hacking
  • Unauthorized monitoring

Content Considerations:

The following restrictions apply to specific operations on our servers and network:

  • TOR Services: TOR exit and relay nodes may only be run on our Dedicated Server Network with Dedicated Bandwidth.
  • IRC Services: Legal use of IRC is allowed on our network. IRC may not be used for prohibited content.
  • Freedom of Speech: The Dutch Constitution respects freedom of speech. Consequently, we do not censor our members based on content. Customers are fully responsible for the content, posts, and articles hosted on our servers or network. Complaints should include a copy of a competent Dutch court order to request content removal. If this is not possible, the complainer will need to work directly with the website operator to resolve the situation.
  • Use of Unlicensed Software: HostRainbow IN does not monitor the software a Customer installs on our servers. Customers are responsible for obtaining appropriate software licensing. In the event of a complaint from a software company, we may request the removal of the software or obtain a valid license to continue operating on our network.

 

Billing & Refunds:

We offer Monthly, Quarterly, Semi-Annually, Annually, and Biannually billing according to the Hosting Plans. We provide a 7-day Money-back Guarantee for our customers to use the service risk-free. Refunds are processed only for Shared Hosting Products.

Our customer portal’s cronjob timing for automation is 2:00 AM IST. At this time, invoice generation, service cancellation, suspension, termination, and late fee addition processes will be done.

We accept Credit/Debit Cards (International and Indian), Net Banking, IMPS, UPI, RTGS, and NEFT. There are no minimum contract periods for any plans.

 

Zero Tolerance Spam Policy:

We take a zero-tolerance stance against sending unsolicited emails, bulk emailing, and spam. “Safe lists” and purchased lists are treated as spam. Any user who sends out spam will have their account terminated without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This includes SPAM sent via fax, email, instant messaging, or Usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account resulting in our IP space being blacklisted will be immediately suspended or terminated.

HostRainbow reserves the right to require changes or disable any website, account, database, or other components that do not comply with its established policies or make modifications in an emergency at its sole discretion.

 

Fair Usage Policy (FUP):

Users may not:

  • Use 20% or more of system resources for longer than 90 seconds. Numerous activities could cause such problems, including CGI scripts, FTP, PHP, HTTP, MySQL, etc.
  • Run stand-alone, unattended server-side processes at any point in time on the server, including all daemons, such as IRCD.
  • Run any type of web spider or indexer (including Google Cash/AdSpy) on shared servers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any BitTorrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers.
  • Participate in any file-sharing/peer-to-peer activities.
  • Run any gaming servers such as Counter-Strike, Half-Life, Battlefield1942, etc.
  • Run cronjob entries with intervals of less than 15 minutes.
  • When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php"), use include("include.php").
  • Any accounts created without updating the name-server or without DNS records pointing to our servers will be removed without notice.

Unlimited disk space and bandwidth mean there are no set limits on our packages. HostRainbow wants you to have the resources you need to build your site without limits.

However, we must ensure a full active service to all our customers. As such, we require all customers to comply with our Fair Usage Policy and Terms and Conditions.

Customers on unlimited hosting packages, including but not limited to shared hosting packages, agree to be subject to the following fair usage policy: The account will be primarily used for web hosting purposes. Unacceptable use includes large file storage and making downloads of large files such as media files, zipped folders, and program files. File downloads are permitted only in the context of a functioning website. The hosting account may not cause performance issues for other hosting accounts on the same server due to excessive resource demands.

If we identify an account that is not in compliance with our Fair Usage Policy or has the potential to negatively impact the server’s performance, we will suspend the account temporarily. We will work with the customer to resolve the issue as quickly as possible. HostRainbow reserves the right to revise its policies at any time without notice. Before placing an order, please read our terms/privacy policy/refund policy. We don’t offer SSH/Shell access to any users in a shared environment. If you require SSH access, consider taking a VPS/Dedicated plan.

 

Shared Environment Policies:

Customers using Shared Hosting, Reseller Hosting, Master Reseller & Alpha Reseller Hosting Plans should run their websites per the defined policies. All sites are hosted in a shared environment, with limited resources allocated to each cPanel. We reserve the right to suspend or terminate any cPanel/account involved in resource abuses, such as excessive CPU, RAM, MySQL, IO, IOPS, or EP usage, with or without notice.

 

Backups and Data Loss:

Your use of this service is at your sole risk. Our backup service is provided as a courtesy. HostRainbow performs weekly backups of shared and reseller servers; however, these backups are for HostRainbow’s administrative purposes only and are not guaranteed. Customers are responsible for maintaining their own backups on their personal computers. HostRainbow does not provide compensation for lost or incomplete data if backups do not function properly (even if the malfunction was due to negligence on HostRainbow’s part). We will do our best to ensure complete and accurate backups but assume no responsibility for this duty. Always back up your site contents to your personal computer! We make no guarantees about the availability of backups. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on HostRainbow servers.

HostRainbow shall not be responsible for any damages your business may suffer. HostRainbow makes no warranties of any kind, expressed or implied, for the services we provide. HostRainbow disclaims any warranty of merchantability or fitness for a particular purpose, including the loss of data resulting from delays, non-deliveries, wrong delivery, and all service interruptions caused by HostRainbow and its employees. HostRainbow reserves the right to change the Terms of Service, Refund Policy, and Pricing of Plans anytime with or without notice. All customers are bound by the newest terms published on the website. We do not allow unprofessional language towards our team; doing so will result in immediate termination of service without a refund.
